TAX RULING RESOLUTIONS (SOLUÇÕES DE CONSULTA) RFB No. 7,011 AND No. 7,013/2026
The Federal Revenue Service reiterated that hospital services and certain diagnostic support and therapy services may use the presumed profit percentages of 8% for IRPJ (corporate income tax) and 12% for CSLL (social contribution on net profit), provided that the service provider is organized, in fact and in law, as a business company and complies with the applicable health regulations.
Simple medical consultations, including when performed in an outpatient setting, remain subject to the 32% percentage.
Analysis: the rulings do not establish a new general rule, as they reproduce an understanding already consolidated by the Federal Revenue Service, including in Normative Instruction RFB No. 2,343/2026. They do, however, reinforce the need for providers to separate, for accounting purposes, revenues from consultations from revenues relating to hospital services and diagnostic support and therapy services, in addition to documenting compliance with the corporate and health requirements.
