STJ establishes qualified precedent on home-use cannabidiol
The Second Section of the Superior Court of Justice recognized the relevance of the federal question and unanimously reaffirmed its case law on the funding of cannabidiol-based medicines for home use.
The thesis establishes, in summary, that operators are not required to fund these medicines where there is no legal, contractual or regulatory provision for coverage. The exceptional import authorization granted by Anvisa, on its own, does not expand the scope of the contract or turn the product into mandatory coverage. The judgment was conducted under the summary procedure provided for in STJ Regimental Amendment No. 55/2026, with recognition of relevance and formation of the qualified precedent in the same session. There was no nationwide suspension of proceedings. The official news item did not identify the case number used for the reaffirmation.
