Refusal of treatment is abusive when there is an express medical indication, judge says
Where there is an express medical indication for a treatment, it is abusive for the health plan to refuse coverage on the ground that the patient does not meet the criteria of the National Supplementary Health Agency (ANS) Utilization Guideline (DUT).
Based on this understanding, Judge Flavio Dassi Vianna, of the 5th Civil Court of Limeira (SP), ordered a health plan operator to provide the drug Pazopanib, within five days, to a patient with cancer in serious condition. The decision imposed a daily fine of R$ 1,000 in case of noncompliance, recognizing the risk of irreparable harm to the beneficiary’s life.
