ANS approves new enforcement model for supplementary health
The National Supplementary Health Agency (ANS) approved, at an extraordinary meeting of the Board of Directors (DICOL) held on Friday, Dec 19, a rule establishing the New Enforcement Model for the Supplementary Health Sector. The initiative represents an advance in modernizing the Agency’s enforcement activity, with a greater focus on preventing conflicts, improving the beneficiary experience and increasing incentives for the adoption of good practices by health plan operators and benefits administrators. Among the main changes brought by the new model are: individual analyses of complaints by sampling, carried out on the basis of criteria previously defined and approved by the Board of Directors; a redesign of planned and strategic enforcement actions; and adjustments to types of infractions and to the amount of monetary fines; ANS approves new enforcement model for supplementary health — National Supplementary Health Agency

The future of digital health in the SUS is a political problem, not just a technical one
In short, these are the points where the substitute text presented in December 2025 errs. There are some dimensions that need to be revised and that seem to us non-negotiable:
(1) Never before contemplated in the SUS, the exploitation of business models and services based on data processed by the National Health Data Network (RNDS) is now provided for. This scenario opens a gap for a possible link between the national health interoperability infrastructure and the data monetization agenda under study by the public administration. Even if it does not involve the sale of data in raw format, it amounts to opening the door to other forms of participation in the circuits of capital, for example, via assetization.
(2) As if the absence of any mention of the National Health Council (CNS) as a participatory body were not enough, the text provides for a RNDS governance body that is given a series of legal prerogatives and is prominently composed of the private sector (hospitals and clinics, health plan operators, laboratories and diagnostic centers, digital health platforms and health information systems). The sector — which is constitutionally recognized, the more legalistic would say — should not occupy structuring roles in public health policy. This body needs to be eliminated.(3) The use of data must be guaranteed only for scientific and technological research, expressly limited to non-profit bodies, through an evaluation process subject to social oversight and to research ethics rules – recently relaxed by the abolition of the Comissão Nacional de Ética em Pesquisa com Seres Humanos – Conep (which raises additional concerns in the case of this Bill).
