ANS consults health plan operators’ ombudsman offices on service to beneficiaries

With the aim of understanding the dynamics between operators and their respective service centers and Customer Service Departments (SACs), the National Supplementary Health Agency (ANS) has opened a consultation with the Ombudsman Offices of health plan operators. The initiative is part of the 2026-2028 Regulatory Agenda, and responses must be submitted by October 20.

The questionnaire also seeks to understand how the Ombudsman Offices monitor the results of these channels, considering that Normative Resolution No. 623/2024 establishes that each operator must adopt its own methodology to assess how effectively the demands received are resolved.

The information collected will support the monitoring of the implementation of the rule, allowing ANS to identify difficulties and opportunities for improving the rules and the regulatory actions related to service to beneficiaries.

Decisions of the 12th Extraordinary Meeting of the Board of Directors

At the meeting held on Oct 2, the Board of Directors unanimously approved a final recommendation in favor of the incorporation of peroral cholangioscopy with laser or electrohydraulic lithotripsy for the treatment of complex biliary stones, where conventional endoscopic retrograde cholangiopancreatography (ERCP) has failed.

The incorporation will be accompanied by a Utilization Guideline. The approved draft provides for mandatory coverage from Nov 3, 2026, but the change still depends on the publication of the normative resolution in the DOU.

The economic evaluation submitted to the Agency estimated average annual savings of approximately R$ 4.1 million for supplementary health, considering the possible reduction in additional procedures and hospitalizations.

The Board also approved preliminary recommendations against the incorporation of the following technologies:

somatrogon, for growth hormone deficiency in children aged three and older and adolescents; and

STF refers to Nusol the discussion on age-based price adjustments in old contracts

The Federal Supreme Court (STF) suspended the conclusion of the joint judgment of ADC No. 90 and RE No. 630,852, General Repercussion Topic 381, and referred the cases to the Consensual Conflict Resolution Center (Núcleo de Solução Consensual de Conflitos — Nusol).

The dispute concerns the application of the prohibition of differentiated pricing based on age to health plan contracts entered into before the Estatuto da Pessoa Idosa (Elderly Persons’ Statute) came into force.

The justices presented different solutions in the two cases, especially regarding the application of the rule to contracts predating 2004 and the effects of any subsequent renewal. The referral to Nusol seeks to formulate a proposal that allows the joint proclamation of the result.
