ANS releases new regulation for self-managed (autogestão) operators

The update modernizes the rules, strengthens governance and reinforces the sustainability of the sector. See the main changes:

Broader eligibility:

· The rule will allow active or retired public servants and family members up to the 4th degree of kinship to be included in the health plans of existing self-managed operators (autogestões).

· It will also be possible to bring together different professional categories and multiple sponsors (legal entities that maintain a relationship with employees and members and contribute financially to fund the plan).

Decoupling of sponsors:

· Correlation between the activities of the sponsors will no longer be required: companies or associations from different sectors of the economy will be able to join together to create or manage self-managed operators.

· A sponsor that decides to stop funding the self-managed operator must give it 90 days’ notice. The self-managed operator, in turn, will have 60 days to notify beneficiaries of the termination of the agreement.

Governance and participation:

· Self-managed operators must have a minimum governance structure, with a board of directors, an executive board and a fiscal council, ensuring the participation of primary beneficiaries and sponsor representatives in deliberative, oversight and advisory bodies.

Sharing of the care network:

· Self-managed operators will be able to share care structures with other operators, promoting greater efficiency and cost rationalization.

Economic and financial improvement:

The regulation consolidates the requirements for technical provisions, guarantee assets and regulatory capital, in addition to new, clearer rules for the financial guarantee agreement signed with maintainers.
